Rules on Disciplinary Sanction


Chapter I: General Rules

Article 1In order to maintain normal teaching and living order of our university, and to build a good living and studying environment, the rules are hereby formulated in accordance with “The Education Law of the People’s Republic of China”, “Higher Educational Law of the People’s Republic of China”, “Regulations on Management of Ordinary Institutes of Higher Learning” and “Management Methods on Recruiting and Training International Students” by Ministry of Education and other relevant laws and regulations, and combined with the actual situation of our university.

Article 2The rules are applicable to the international students of all grades and of all types who are studying in our university (hereinafter referred to “international students”).

Chapter II: Sanction Types and Specific Application

Article 3Except normal criticism and education, when the situations in conformity with the rules occur, disciplinary sanctions shall be taken against the international students who have broken the law, got out of line, or violated the disciplines (hereinafter referred to “violated the disciplines”).

Article 4Disciplinary sanctions shall be divided from mild to severe into warning, serious warning, demerit recording, academic probation, and expulsion.

Article 5Those who make minor offences as not subject to the sanctions according to the rules, oral criticism, written review, correction within deadline, circulating a notice of criticism, etc. shall apply.

Article 6A minor punishment shall be given when there is one of the following circumstances:

Admitting mistakes voluntarily and showing repentance;

Assisting actively the organization in investigating and treating problems;

Disclosing the disciplinary offence of others, which is proved to be true through investigation and verification;

Other circumstances subject to lesser punishment.

Article 7Heavier sanction shall be given when there is one of the following circumstances:

Still showing a bad attitude without repentance after education;

Intentionally concealing disciplinary offence, providing perjury, and hampering investigation and treatment;

Threatening and retaliating the prosecutors, witness, or working personnel;

Having two or more kinds of disciplinary offences in the meantime;

Coming up with another disciplinary offence subject to punishment after punished;

Committing a crime with people outside our university;

Playing a leading role in group disciplinary offence matters;

Other circumstances subject to heavier punishment.

Article 8Those with minor punishment circumstances stipulated in the rules shall be handled by the next level of sanction rules; those with heavier punishment circumstances stipulated in the rules herein shall be handled by the previous level of sanction rules.

Article 9All persons sanctioned, the qualification for appraisal of all kinds of scholarships, student subsidies, and honorary titles within one year shall be cancelled.

Chapter III: Disciplinary Offence and Sanction Rules

Article 10International students shall abide by Chinese laws and regulations, and shall not say words or do deeds opposing and attacking China, other nations or ethnics. Where there is one of the following situations, depending on the seriousness of the case, the offender shall be given the punishment including demerit recording, academic probation, or expulsion:

1. Organizing or joining unapproved assembly or parade, organizing and inciting disturbance, disturbing social order or destroying normal teaching order, and destabilizing unity;

2. Spreading the information that violates Chinese laws and regulations as well as university disciplines and regulations;

3. Organizing, setting up or joining illegal social group or organization, organizing and setting up unapproved student society, and publishing illegal periodicals;

4. Organizing to carry out unapproved social, political and academic activities or holding unapproved saloon, club activities, etc.;

5. Carrying out religious activities including religion preaching, religious party, etc. in the campus.

Article 11Those who have violated Chinese laws and regulations, and are therefore punished by public security and judicial departments shall be given sanctions according to the following rules:

For those punished by public security warning or public security penalty, serious warning, demerit recording, or academic probation shall be given depending on the seriousness of the case;

For those punished by security detention, academic probation shall be given;

For those who have violated Chinese laws which constitute criminal offence, expulsion shall be given.

Article 12Those violating regulations of our university, affecting educational and teaching order, life order and management order in public places, infringing the legal interests of other individuals or organizations, serious warning, demerit recording, academic probation or expulsion from academic status shall be given depending on the seriousness of the case.

Article 13Those having violated regulations of our university for many times (three times or above) and therefore having been given disciplinary sanctions but still refusing to correct after education, the sanction of expulsion from academic status shall be given.

Article 14Those who exchange blows, pick quarrels or make troubles shall be given the following punishment depending on the seriousness of the case:

1. Wreckers (failing to observe order without listening to the dissuasion, using words to provoke or stirring up trouble in other ways):

(1) Those having not beaten others, but teased or favored one side, worsening the situation and thus being the fight, shall be given punishment with a warning or a serious warning;

(2) Those having beaten others but have not caused injuries to others shall be given punishment with a serious warning;

(3) Those having beaten others and caused injuries of others shall be given the punishment from demerit recording till expulsion, which depends on the seriousness of the case.

2. Plotter:

(1) Those who plot, abet, or instigate others to fight, but have caused no consequences shall be given a demerit recording as punishment;

(2) If any consequences are caused, the punishment from demerit recording to expulsion shall be given depending on the seriousness of the case.

3. Those involved in a fight:

(1) In name of “mediating” between two quarrelling parties, but favored one side, worsening the situation and thus being the fight, shall be given a warning or a serious warning punishment;

(2) Those having beaten others but not caused injuries to others shall be given serious warning punishment;

(3) Those having beaten others and caused injuries of others shall be given the punishment from demerit recording to expulsion from academic status, which depends on the seriousness of the case.

4. Those providing tools for fights:

(1) Those having caused no consequences shall be given a demerit recording punishment;

(2) Those having caused consequences shall be given punishment from demerit recording till expulsion from academic status.

5. Attackers with tools:

(1) Those who have not caused injuries to others shall be given demerit recording or academic probation punishment;

(2) Those who have caused injuries (decease) to others shall be given sanction from academic probation till expulsion from academic status, which depends on the seriousness of the case.

6. Those who draw others together to fight and cause troubles in campus, or play a key role in gang fight and troubles outside campus, or lead a gang war shall be given sanctions from academic probation till expulsion from academic status; the participants shall be given the sanction from demerit recording till expulsion;

7. Those having caused injuries to others due to disciplinary offence shall assume civil compensation responsibility according to relevant laws and regulations.

Article 15Those who possess illegally others’ property by means of stealing, swindling, blackmail, cheating, the following punishment shall be given depending on the seriousness of the case:

1. Serious warning shall be given for value below 500 Yuan;

2. Demerit recording shall be given for value above 500 Yuan( including 500 Yuan, the same below) and below 1000 Yuan;

3. Expulsion shall be given for value above 1000 Yuan;

4. For those who have caused other serious results due to stealing, swindling, blackmail, cheating, the sanctions such as serious warning, demerit recording, academic probation or expulsion from academic status shall be given;

5. For those who refuse to correct errors after repeated education and commit offence repeatedly, the sanctions of academic probation till expulsion from academic status may be given;

6. Those who shelter or shift the proceeds of crime for perpetrator, the sanctions above serious warning shall be given depending on the seriousness of the case and referring to the level of sanction given to the perpetrator.

Article 16For those who gamble (or provide conditions for gambling)with cash, negotiable securities, account deposit (including electronic account) or other articles as gamble fund, in addition to confiscating gamble fund and device, the following sanctions shall be given depending on the seriousness of the case:

1. Those participating in gamble for the first time shall be given demerit recording sanction;

2. Those organizing gambles or participating in gambles repeatedly shall be given academic probation sanction; those using relatively large amount of gamble fund or causing serious consequences shall be given expulsion from academic status sanction;

3. Those providing conditions for gamble shall be given the same sanction as given to the gamblers.

Article 17Those who molest, insult, harass others by physical act, language, words, pictures, electronic information and other ways shall be given sanctions including serious warning, demerit recording, or academic probation.

Article 18Those who have violated dormitory management regulations with the following situations shall be given the relevant sanctions:

1. Those staying out all night without permission shall be give warning. Those in cases of gross violation shall be given serious warning till academic probation;

2. Those who put up people outside the university for the night without permission shall be given sanction of warning or serious warning; those who accommodate a person of opposite sex for the night without permission shall be given the sanction of academic probation;

3. Those who illegally use electricity, fire and other hazardous articles shall be given warning or serious warning; those who cause fire or other liability accidents, in addition to compensation for losses, shall be given a demerit recording, or given academic probation till expulsion from academic status if the case is serious;

4. Those with other behavior in violation of the management provisions of student dormitory shall be given the sanctions like warning, serious warning, demerit recording, academic probation or expulsion from academic status, which depends on the seriousness of the case.

Article 19Those who watch, duplicate, manufacture, spread, or sell illegal books, illegal audio and video products, obscene goods shall be given the following sanctions, depending on the seriousness of the case:

1. Those who read illegal books and periodicals, illegal audio and video products, obscene goods shall be given sanctions above warning;

2. Those who copy, manufacture, spread, or sell illegal books and illegal audio and video products, or obscene goods shall be given the sanction of demerit recording or academic probation; and those with serious violation cases shall be given the sanction of expulsion from academic status.

Article 20Those who take drugs, introduce others to take drugs, or do drug-trafficking shall be given sanction of expulsion from academic status.

Article 21Those with the following behavior shall be given the sanctions like warning, serious warning, demerit recording, academic probation or expulsion from academic status, which depends on seriousness of the case.

1. Littering or smashing objects, creating disturbance, drinking and causing trouble which disturbs the normal teaching, scientific research, work and living order on campus;

2. Causing troubles to the teaching staff;

3. Obstructing or refusing school administrators to perform their official duties in accordance with the law and regulations;

4. Insulting, slandering, falsely accusing, framing, threatening, maliciously harassing or harming others;

5. Providing false testimony, forging or tampering with documents, certificates or having other falsification behavior;

6. Leasing, lending or transferring certificates;

7. Concealing, destroying or disclosing other people’s mail;

8. Organizing or participating in heresy or feudal superstition activities.

Article 22Those who intentionally damage school property and other persons’ property shall, in addition to compensation for all economic losses, be given sanction above serious warning according to the seriousness of the case.

Article 23Those who post and distribute propaganda in the campus without approval shall be given sanctions of warning and serious warning depending on the seriousness of the case.

Those who participate in illegal pyramid schemes, carry out business or other activities in the name of others or fictitious name shall be given the sanction above demerit recording, depending on the seriousness of the case.

Article 24Those who violate the regulations on computer information network management shall, depending on the seriousness of the case, be punished as follows:

1. Those who embezzle other people’s IP address or user account number, shall be given sanction of warning or a serious warning; if the case is serious, the offender shall be given sanction of demerit recording till expulsion from academic status;

2. Those who deliberately produce or disseminate computer viruses and other destructive procedures, destroy the normal operation of computer system, shall be given the sanction above serious warning, depending on the seriousness of the case;

3. Those who use Internet or other communication tools to do illegal activities, infringe upon the rights and interests of others, disseminate illegal words, audio and video materials, fabricate or disseminate false or harmful information, shall be given sanctions above serious warning according to the seriousness of the case.

4. For those who illegally use or change the information system functions or the data and application program stored, processed, transmitted in information systems of computer, the sanctions above serious warning may be given according to the seriousness of the case.

Article 25Those who leave arbitrarily our university or play truant (absent without permission in the activities specified in educational and teaching plan of our university or the collective activities organized by our university) shall be punished as follows:

1. Those who leave our university arbitrarily (including holidays and festivals)

(1) Those who leave our university arbitrarily for more than three days (including three days) shall be given sanction of warning or serious warning;

(2) Those who leave our university arbitrarily for more than seven days (including seven days) shall be given a demerit recording sanction;

(3) Those who leave our university arbitrarily for more thanten days (including ten days) shall be given academic probation sanction;

(4) Those who leave our university arbitrarily for two consecutive weeks shall be dropped out automatically.

2. Those who play truant for following study hours in a term (accumulated according to the actual class hours, the activities such as practice, design, thesis, collective activities shall be counted as 4 class hours per day, late coming or early leaving three times converts one class hour of truancy)

(1) When10 class hours are accumulated, a sanction of warning shall be given;

(2) When 20 class hours are accumulated, a sanction of serious warning shall be given.

(3) When 30 class hours are accumulated, a sanction of demerit recording shall be given.

(4) When 40 class hours are accumulated, a sanction above academic probation shall be given.

Article 26Any person who cheats in examination (including check) or violates the discipline of examination shall, depending on the seriousness of the case, be given the following sanctions:

1. Those who violate the discipline of examinations shall be given sanction of warning or serious warning;

2. Those who cheat in examinations shall be give sanction above demerit recording;

3. Those who take exams for others or allow others to take exams for themselves, organize cheating, cheat by means of communication equipment or other equipment, sell examination questions or answers to others for profit, or cheat seriously or disturb examination order shall be given the sanction of expulsion from academic status.

Article 27Those who violate academic moral rules, depending on the seriousness of the case, shall be given the following sanctions:

1. Those who plagiarize, copy research results of others in course assessment shall be given sanction above demerit recording;

2. If serious academic dishonorable behavior such as copying, tampering, forgery, etc. exist in academic dissertation or published research results, or there are thesis written for others or thesis buying or selling, the violator shall be punished by expulsion from academic status;

3. Whoever, when publishing an academic paper, uses the signature of another person without the consent of the person, or marks the project-funding person without consent of the project principal shall be given a warning as punishment; or given serious warning or demerit recording as punishment if the case is serious;

4. Those who publish multiple contributions with one academic paper manuscript shall be given a warning; or given a serious warning or demerit recording if the case is serious;

5. Whoever falsely opens or tampers with a letter of acceptance of a published article shall be given serious warning; or shall be given sanction of demerit recording or academic probation if the case is serious.

6. Whoever misuses, sells or disseminates without authorization the technological patents, proprietary data, confidential information, paid use of software and other undisclosed technical achievements of the research group shall be given sanction of academic probation, or the sanction of expulsion if the case is serious.

Article 28If any other behavior other than the rules occurs, and sanction applies, it may be handled with reference to similar provisions of the rules.

Chapter IV: The Procedure and Limits of Authority of Disciplinary Sanction

Article 29The sanction on international students shall be based on sufficient evidence, clear basis, accurate quality, proper procedure and appropriate punishment.

1. The relevant functional departments and colleges should investigate in time after the international students violate thediscipline, and Overseas Education College shall submit disposal proposals within one week after investigation materials are complete;

2. The sanctions including warning, serious warning, demerit recording, academic probation shall be reported by Overseas Education College to leader in charge of our university for approval;

3. The sanction of expulsion from academic status shall be reported by Overseas Education College to the leader in charge of the university, and finally decided on administration meeting of university president;

4. Before a decision on sanctions of an international students made, a proposed punishment letter shall be issued to the international student, to inform him/her of the facts, reasons and basis of the proposed decision, and to inform him/her of the right to state and defend himself/herself.

Article 30When our university gives sanction on an international student, a Decision of Sanction shall be issued. The Decision of Sanction shall include the following contents:

1. Basic information of the international student;

2. The facts and evidence for the sanction;

3. The type and basis of the sanction;

4. Other necessary content.

Article 31Overseas Education College shall promptly deliver the Decision of Sanction directly to the international student who is to be punished, and the student shall sign after receiving it. If the international student refuses to sign and receive it, it may be served by leaving there and filing; for those who have left our university, it may be served by mailing; for those hard to contact, it may be served through university website, news media and so on by means of bulletin.

Article 32The international students who have been given sanction of expulsion from academic status shall handle leaving procedures within one week after the sanction decision is made.

Chapter V: Supplementary provisions

Article 33The “above” or “below” about the limits and extent of sanctions in these rules shall include these rules themselves.

Article 34Our university authorizes Overseas Education College to interpret the rules.

Article 35The rules shall enter into force as of the date of issuance.
